I pruchased my mobile home in 2000 under Green Tree financial and never had any problems or complaints. When I had surgery I was out of work longer than expected and they put 3 months of payment at the end of the note to help me through this hard time. I went back to work with the same company and was able to make my payments on time until I was forced into early retirement in October 2015. Sometime along the way I thought they sold my account to Ditech which turned out to be the first lie because they merged back with Ditech, Ditech actually owned Green Tree. Anyway I struggled to make my payments until April 2016 so I asked them if they would move 3 more months to the end of the loan and they did. During this time I was looking for work and only found a part time job for 2/3 of what I was making before. I turned 65 so had to join Medicare and that monthly premium along with the supplement and prescription drug policy really put me in a bind, but I struggled through.

Then in October I was Laid off again. I missed a couple of payments and in December 2016 I contacted Ditech to find out what options I had in order to keep my home. By this time I started receiving my social security so I could make a lower payment so they sugested a loan modification with lower interest to make it more affordable for me. Now this sounded great. In January 2017 I got a call from Andraes wanting me to make a payment. I explained that they were working on a loan modification for me so he looked in his computer and said yes they are working on it and should have it done soon and that they would let me know what my new payment would be and not to make a payment at this time. So I didn't make a payment. The next month he calls again and I explained that they have not let me know my new payment yet so I didn't have to make one. This went on for a few months and I thought every thing was ok. All of a sudden someone new calls, I don't remember the name, so I explained what was going on with the loan modification and again was told that they are still working on it and no need to make a payment until it is final. Then someone else calls and I explained again and they said that they want a payment before they take it any further so I made one. Now here it is October. On the 6th I got another call wanting a payment so I made one and she offered to email a receipt to me which still has not come. She also told me that according to the notes in the computer that Ditech sent me a letter of denial back in December. Well guess what---that never came either and all this time I thought everything was fine with my account. With every person I spoke to I asked for something in writing as to what was said and what was going on and every time I'm told that they don't do that.

On the 11th I received a certified letter of default demanding payment of 5252.36 less the payment I made on the 6th by the 26th or they can come in and take possession. So I guess they will have to come and get it. We have no place to go, my husband just had a major heart attack 3 weeks ago and he also has ALS so we have medical bills again and he can't do much of anything. We have NO money so unless his brother will let us stay in his basement we will be forced onto the streets.

Ditech Financial, LLC is a mortgage service collection agency. Part of their mortgage servicing includes providing the mortgagor with a RESPA compliant Annual Escrow Disclure Statement, which is supposed to conform to 12CFR10254.17. Ditech accounting refuses to comply with RESPA 12CFR1024.17 and insists on following their own rogue computing method even though their software will provide the correct information if the accounting department will place the information correctly. Due to Ditech's maverick accounting, the Annual Escrow Disclosure Statement misrepresents the true status of the mortgagee's escrow account and contains blatant basic math errors. Ditech accounting will disburse property bills at their disgression up to 20 days before the Escrow Statement date, which puts the escrow account one month in Deficit. The result is an increased cost to the mortgagor in the next accounting cycle over any usual property bill increases. Complaints to Ditech Customer Service are answered and your complaint will be disregaged. The only solution I have found as a mortgagor is to pay all my property bills directly and send Ditech Financial, LLC Customer Service copies of all the receipts. At least, Ditech accounting knows how to return escrow overages!

Ditech servicing LLC has made continuous errors on my account for over one year.

I refinanced with Ditech for a HARP Loan in or around March 2016. (They were already the current servicer of my previous loan)

I have been providing them partial payments of $500 for over 9 months every 2 weeks from June 2016 to May 2017 (partial payments was a normal practice I adhered to on my previous loan)

My current mortgage due monthly is $881.57

Ditech has been funneling bi-weekly payments into an account called unapplied funds account. (Their policy is that partial payments are sent to this account until the full payment is received and then is to be applied)

They have not been adhering to their own policy and have accrued funds in their unapplied funds never applying to payments causing late fees.

From July 2016 – March 2017, I called and spoke to representatives, supervisors, and directors and was told that the continued error that were made would be fixed.

In February 2017, my accountant and I noted discrepancies on an issued 1098 from Ditech and it prompted an inquiry and a further review revealed additional errors being applied to my account.

In March 2017, a director Andrea Lutz and a loan specialist explained to me that Ditech has no way to recognize partial payment or overpayments and it was contributed to an upgrade in their system. A reallocation of funds was conducted to apply for payments correctly from the last 9 months.

After the reallocation was completed, I was informed that my loan was paid up 1 month in advance.

After the reallocation was applied, I noticed my principal balance increasing.

The reallocation applied caused my account to go in default, caused additional late fees to accrue and again I was never made aware of.

I was sent four collection letters and a representative came to my home.

In May 2017, I received a notice stating my escrow was short and my monthly payments would increase.

Ditech alleged my property taxes had increased. However, the city treasurer refuted that claim when provided in writing that my taxes had remained the same.

Ditech’s AVP alleged Ditech received my storm water bill from the city and would take over paying that. I have been paying my storm water bill on my own through web bill pay and was current on my bill.

Another escrow analysis was completed on 7/6/17 and I was sent a notice stating I was in surplus of $386.71 and my monthly payments would be decreasing

Another analysis was completed on 7/7/17 and I was sent a notice stating I’m in a shortage for $245.45 and my monthly payments would be increasing

They have contacted my property insurance company and requested the name of the mortgagee be changes to several names, one of which is listed as “associated affiliates”. They have ignored all requests for all the name of associated affiliates

They have disabled my capability to obtain my pay off quote, they refuse to respond to my inquiries of the reallocation completed in March being incorrectly applied. They continue to hold my payments in their applied funds when the exact dollar amount is now being provided. I have a library of recorded calls with the organization of over 150 calls made to them regarding multiple errors. One of which when two employees specifically convey to me this is an ongoing practice of the organization (mishandling funds). I announce on my recordings that all calls are recorded.

My name is Daisy, and I have completely been given the shaft by Ditech. To say that they don’t care about their customers is an understatement. However, before I go into how completely deplorable they are, I’d like to precursor these statement of facts with evidence of faxes, emails, upload links, cellphone histories, etc. that are all available upon request. So, here is my story…

I bought my second home in May of 2015. My loan was sold to Green Tree Lending in July of 2015. In late August of 2015 I received a Supplemental Property Tax Bill from the County Assessor’s Office indicating a payment was going to be due 12/10/15 (1st Installment) and 04/11/16 (2nd Installment). My previous mortgage holder was JP Morgan Chase Bank, and when I received a Supplemental Tax bill from the first home a purchased, they told me to send them a copy of the bill and that they would take care of the supplemental as I was escrowed for taxes, and the supplemental is always calculated in the purchase of the home (They were AMAZING!!! Never had an issue with Chase). Well when I called Green Tree on 09/16/15, I was also assured by their tax department that they would pay the Supplemental as there was a surplus in my escrow account. So, great—or so I thought, the next year plus has been a series of unfortunate events and endless circles of no one giving a crap about what I’ve been put through.

So, I faxed over my Supplemental tax bill on 09/17/15 (fax confirmation received), and called back 10/13/15 to make sure that the fax was received, and a payment was to be scheduled out. I was again assured that Green Tree had scheduled the payment, and everything would be okay and even emailed them on 11/06/15 to confirm. December 2015 mortgage statement came, and I saw no debit for the supplemental tax bill that was due on the 10th. I called on 12/01/15 and was told that the payment was scheduled and would be reflected on the January escrow statement, so I waited. January no payment was reflected, and the county assessor was now charging me late fees and penalties. I called 01/18/16 and was now told that issues had arisen with the change from Green Tree Lending to Ditech, and that some things were missed or got lost with the transition. I was told to call back in 10 days to give them time to research the problem. On 01/29/16 I called and was told to fax the Supplemental tax bill and confirmation again, along with a letter requesting for the penalties and fees to be refunded, as this was their fault. I obliged and sent in everything as they requested and have confirmations of faxes received. On 02/02/16, I called and asked if the payment had been made, and they indicated it was scheduled for 02/06/16, and to call back after the 6th. I called 02/10/16, and was told it was sent out and that they would credit me $146.26 in penalties and fees. I was assured by that same representative that it was in Ditech’s system to pay the 2nd installment supplemental on the scheduled due date of 04/11/16. I called 03/24/16 to make sure the 2nd installment would be paid and was assured it would be, and also called about the $146.26 that I had not seen credited to my account or was given to me via a check. I was told that Ditech was working on getting me a check for the penalties and fees, and that it was already in the second approval phase with management. Awesome, or so I thought.

By April, you guess it—my 2nd installment supplemental was NOT paid!! I called on 04/06/16, they told me to wait until May—by 05/13/16 I called again and they apologized profusely and stated it was scheduled to be paid in June. On 06/16/16 I emailed Ditech asking why the 2nd installment had not been paid. I received a letter 4 days later stating they were reviewing my request. I called Ditech on 06/27/16 and was told that the payment was scheduled to be paid and to call within a week—I did, and they still had no answer, but that a supervisor would call me with a status. I received no call back. On 07/13/16 after no response, I called Ditech and was told that Ditech would not be paying my 2nd supplemental. I was told that Ditech could pay it, but that my escrow account would now be short as Ditech had done a reconciliation (Annual Escrow Analysis in June 2016) on my account and found that they were taking out too much for taxes, and they had sent me out a surplus check for $2,786.72 on 06/30/16. Well the 2nd installment was due 04/11/16, and had now accrued late penalties and fees of $282.50. Ditech stated to write a letter to have those fees credited, as it was their fault for not paying the supplemental as they had told me they were going too—but please keep in mind they had never credited me for the $146.26 for the 1st installment! Ditech indicated that I would be credited the fees and interest once I faxed over proof of payment with the fees listed—I did so on 07/26/16, along with a letter detailing the series of events.

I called on 07/27/16, 08/19/16, 09/13/16, 09/26/16, 10/04/16, 10/06/16, 10/07/16, 10/11/16, and 10/14/16 requesting the whereabouts of the penalties and fees that were to be credited to me in the amount of $428.76 for the late payments of supplemental installments that Ditech indicated they were going to pay, but failed to do so. On 10/25/16, I received a second “Annual Escrow Analysis” now indicating they miscalculated and my escrow account would now be short! This to me feels like I’m being PUNISHED for wanting back monies that are rightfully mine. On 10/26/16, I emailed Ditech asking why they were issuing out Annual escrow analysis to me in 3 month increments? Well of course the account would be short in the computer, a payment would have just gone out in October for November regular property taxes! My regular payment at the beginning of the loan was $2,897.52 ($1,955.99 in principal & interest, and $941.53 escrow for taxes & insurance), then in July it changed to $2,673.08 ($1,955.99 Prin & Int and $717.09 escrow for taxes & insurance) due to a “surplus,” and now my November payment went up to $3,024.92 ($1,955.99 Prin & int and $1,068.93 escrow for taxes and insurance) due to a “shortage.” So, my payment went up $351.84 due to an escrow “shortage,” but no one can explain to me how, or will even call me back. I have been told for weeks that a supervisor will call me back—not once have I ever been allowed to speak with one, even after several times of requesting to speak with one. I sought out legal advice and had an attorney write me a letter in the hopes that someone would call me back—nothing! On 11/15/16 was my final call to Ditech, again I was given the runaround. No supervisor was available for me to speak with, and no one could tell me why my payment went up or why an annual analysis was being done 3 months later from a previous one, or where my darn check was for the fees and penalties!

It is blatantly obvious Ditech has no intention of paying me back my fees, and even went as far as increasing my payment as punishment for requesting those fees to be credited. To date no one has ever responded. I hope someone will read this and no know what a horrid work ethic they have, and I pray to God that they will reap what they sow.
