This incident occurred between April 4, 2023 through April 10, 2023.

CHARGED THROUGH MY PAYMENT MERCHANT WITHOUT MY CONSENT.

I was perusing the Derila site and added a number of items to the shopping cart. I connected my payment merchant account to the site and upon clicking to view the cart/items discovered that the items I was interested in (four of them) had been charged to my account. I did not intend to make a purchase, I wanted to review the cart and make a decision from there.

The items were charged to my account and this was not my intention. In addition to the items being charged to the account I noticed that I had been signed up for a 'billing agreement' (recurring payments) to my payment merchant, which I was able to immediately cancel.

I contacted Derila within minutes of the erroneous purchase and the run around began.

1) I was told that they would in fact cancel my order, but it would take up to 24 hours to receive an email confirming the cancellation. I challenged the notion that an unauthorized purchase could be charged to my account within seconds of adding my payment merchant, but I needed to wait for 24 hours to confirm cancellation. Based on other reports of the company (BBB) I determined that this is a ruse bc after 24 hours the customer is routinely told the order cannot be cancelled bc it has already shipped.

I requested to speak to a supervisor and was denied access. Within an hour I received an email stating that my cancellation was in progress and that it would take 3-5 business days to process my refund. No order information (including the order number and product information) was included in the email. I responded to the email demanding a detailed cancellation email that included the order number and did not receive a response.

2) I contacted my payment merchant and filed a dispute, fully explaining (in writing) the details of my experience. I requested a refund for all four (4) of the erroneous transactions (they charged each item I added to the cart seperately - setting up four automatic payments in the process). I understood at this time that the process could take up to fourteen (14) days.

3) That same afternoon I received a call from Derila support (after my dispute was filed) and I was told that I needed to cancel my dispute in order for them to process my refund. THIS IS CLASSIC SCAMMER 101. What they know that most consumers do not is that if the consumer cancels a dispute with their payment merchant for any reason, it can NEVER be refiled.

I asked the SCAMMER why he was contacting me and not the payment merchant, bc it was being handled by them, informing him that his call to me was improper. He deflected and again demanded that I drop the dispute bc it would prevent me from receiving a refund. After becoming annoyed bc I pointed out the fact that his actions were the equivalent of a threat and refusing to allow him to intimidate me he became agitated and eventually hung up on me.

4) I received an email a few days later stating that Derila could not process my refund bc of the dispute. I also noticed that the order itself appeared to be processing on their end. I understood that this was likely an effort to indicate to the payment merchant that they could not refund my monies bc the items had shipped. Having fully documented my interactions with Derila and informed them of my recording their calls - this did not concern me.

I made sure to update my payment merchant dispute DAILY - adding the emails, updates to the order and audio from the call to my dispute.

To my knowledge Derila NEVER contacted the payment merchant.

I received a FULL refund on April 10, 2023.
