I hired Mr. Dallas Pennington in April of 2014 through a referral from a friend in my industry. I saw the work that Mr. Pennington had done at my friend’s house, and I thought it was done well. I called Mr. Pennington to schedule an appointment to come take a look at the work I needed done at my house.
Mr. Pennington went over all the details of laying a tile floor down in my house and seemed knowledgeable and friendly. We came to an agreed price for installing the flooring, and Mr. Pennington explained that he had two other jobs to finish up and could get to mine next with a down payment of 35%.
I agreed and paid Mr. Pennington the 35% down payment and waited for 2 weeks to contact him again and get an updated schedule. At this point Mr. Pennington explained that the he was having to extend the wait time another two weeks as the client he was working for had made changes to the project that would take him another week.
I waited another week and called Mr. Pennington 3-4 times before he finally called back. He stated that his current job was going to take at least another week. I was not happy with this circumstance but was not in a major hurry to get the job done, so I let it slide for another week.
I was now having problems getting hold of Mr. Pennington. When I did speak with him, he said that his job was in the middle of nowhere and had bad reception. It was now a month into this ordeal, and I was getting extremely suspicious. So, I asked to receive my money back and told Mr. Pennington that we could try to do this at a later time in the year. My job requires that I go out of town for extended periods of time, and a new job was coming up where I would be gone for about two months. I wanted to resolve this before I left, but Mr. Pennington explained to me that he did not have them money and was still waiting to get paid from his customer and on some other jobs.
I explained to Mr. Pennington that this was not my problem and that he had two weeks to pay me before I took legal action against him. I called the Attorney General office of Kansas and Missouri as the work to be completed was in Kansas and he lived in Missouri. The AG offices for both states stated that I would need to go to court in Kansas first and get a judgment against him and then take it to the court in Missouri to try and win a judgment against him. I simply did not have the time for this.
I then hired an attorney to go after him, but Mr. Pennington has been able to avoid being served the paperwork to be summoned to court. Mr. Pennington has since taken two jobs that I know of, the first being with Jericho Home Improvements and the second at AAS Restoration. I have contacted both companies to let them know what kind of a person Mr. Pennington is and how he ripped off me and my family.
I had to stop trying to serve him papers due to the expense but will try again when I have time and money.
