I recently went to my local county tax office to register a motorcycle I bought from an auction. They wanted to charge me tax based upon the standard presumptive value. I told them that this vehicle was bought from a dealer and it is a salvage title so it is exempt according to the documentation on the DMV website. The regulations on the website specifically state that vehicles bought from a dealer or are salvage are exempt and are charged at a rate of 6.25% of the amount paid. The supervisor told me that his hands are tied and gave me a tax dispute form to file with the state comptroller. I even went back there with my receipts from last year for two salvage vehicles which I purchased that were done correctly. I called the state comptroller and they told me to try another office. I went to another office in Garland and they wanted to charge tax based upon the standard presumptive value as well. I could not find any information that the regulations have changed since last year, if so then why does the website still have the same regulations for exempt vehicles outlined for standard presumptive value as last year? The standard presumptive value regulation went into effect in 2009 to recoup significant tax losses in TX due mainly to private part transactions in which people would lie about how much they paid for a vehicle to lower their tax bill. Vehicles bought from a dealer are exempt due to the fact that there is a bill of sale and a title transfer filled out by them with their GDN. I don't know if they are doing this on purpose to get more tax revenue from unsuspecting individuals or they are not very well trained. I need someone to help investigate this. If this is the case then this would be a good story for the media to expose the tax offices cheating people out of possibly tens of thousands or more per year.
