Due to medical issues I was going to sell my house which was in foreclosure. The house was to be auctioned. Mr. Washington and his employees came to my house to look it over. In order to ger it off of the auctioning block he paid the back mortgage payments and gave me $10,000. The deal was that he would payoff the first and second mortgages and after 30 days me and my wife would leave the house and he would give us the remaining $10,000. After looking over the contract for a long time I noticed that he removed the payment of the first mortgage and instead placed repayment of the cure amount of the back payments of which he had no intention of paying since he was not going to be paying off the first mortgage. In Colorado there is a three day rescision period. I notified him by sign receipt mail, text and email stating I was backing out of the deal.

He agreed, but wanted his $25,123.10 back in exchange for the deed. The contract actually had no provision for a cancelled contract, but I thought it fair he should have his money back. A friend of mine told me he tried to file the deed with the county trustee the same day I rescinded the deal, but the county trustee wouldn't do it. I told him to knock it off or I would go to the police, which I did.

After the police did nothing (surprise) he sued me for my house instead of the $25,123.10, which I thought he would do and looked forward to it since the court would monitor the payments. In the first lawsuit in small claims court he made no progress so he went to district court. His attorneys never served me and thus won the house by default judgement. I never received any communication that there was a pending eviction. The cops came and told my wife and I to get dressed, grab a coat and our medication (if we had any), our pets and to leave. The police forced me to put the pets in the car and to get a moving truck. The movers who turned out to be Washington's wife, Hosetta and some thugs began to destroy China that was made prior to World War 1, stole some medication, jewelry and some of my watch collection. The police did nothing and my wife thought that an eviction is supposed to go down that way. When I returned she was fending off the leaches of the neighborhood and trying to get Hosetta and her thugs to get her some of the decor screwed to the wall, which they did not. I told my wife that this is not n**i, Germany and that the police are to make sure that personal property doesn't get destroyed and to make sure no one is hurt during the process. Of course the police just stood around and did nothing, but leave early.

After days of living in the car with our pets and packing the rest of our belongings during the day she collapsed from fatigue and exhaustion. I placed her in the truck and told her to try and relax and sleep. I finished the moving. I filed a motion to re-hear the proceedings and to immediatly halt the eviction proceedings which Judge Vought of district court 202 denied. Finding legal help with this has been impossible. This guy is getting away with stealing my house for $25,123.10. Any legal help would be greatly appreciated. This guy has done this before and will continue to do so till he and his wife are placed in jail. After doing some of my own research he violated almost every 2006 Colorado foreclosure protection law. It is like almost everyone is asleep in civil court and although this judge has a nice dosier she doesn't further the law, yet collects a nice paycheck.
