♣ 11/15/2013 - John J****** a single man entered into a realty contract with my wife and I to purchase our home. The original offer was for $674,900.00. John J****** place $10,000 in the good faith escrow account with Chicago Title. The contract stated John J****** had 17 days to cancel. The Chicago Title Escrow account number is 51128760-**. Chicago Title Company Escrow officer name is Gina Belletto In Modesto, California.
♣ Approximately January 2, 2014 our realtor gave us the news John J****** had backed out of the deal. When pushed we were finally given a hand written letter by Mr. J****** dated December 26, 2013 that he was withdrawing his offer. This change of mind was 42 days after the accepted off was signed. Mr. Johnson was only given 17 days to back out of the offer.
♣ 2/6/2014 - We received a summons and subpoena to appear in Madera County Superior Court case number MCV0667**. This was a frivolous suit as the escrow and home were both in Stanislaus County and all parties resided in Stanislaus County or out of state. In this case John J****** was never served and never new there was a case. The law firm of Hershorin and Henry LLP representing Chicago Title Company, had the wrong address for him and never served him. I immediately called and told the attorney in charge of the case, Jason R. Burris, we were settling this case out of court or in small claims we did not need his help. I also told him he could not take us to court in Madera as none of the parties’ addresses were in that county.
♣ 3/11/14 – We filed a motion to quash the summons in Madera County Court case number MCV0667**, stating Madera Superior Court lacks jurisdiction over the persons of this defendant. The plaintiff, Hershorin and Henry LLP stated inaccurately we lived in Madera. I had repeatedly told Jason Burris we did not live in Madera county, he was well aware what he was doing was not legal or ethical and was wasting his time, Hershorin and Henry LLP time and money as we already had a case going in Stanislaus county. In the Madera Motion to Quash page 2, line 15 through 17 it stated emphatically “Furthermore, there is already a court date set for April 18, 2014, in Stanislaus County Small Claims Court to hear this case between John Johnson, Ralph Keith and Debra Bonsack." The Stanislaus Small Claims case number is 21003**.
♣ 6/12/2014 Madera Superior Court Judge Oakley upheld the Motion to Quash as it was not in his jurisdiction and there was another court date already set in Stanislaus County Small Claims Court as stated in the Motion to Quash.
♣ 11/25/2014 - went to Stanislaus County Small Claims court. Heard case number 21003**. We agreed with J****** and the mediator we would settle for John J****** paying us $5037.00 of the $10,000. In escrow. This paper work has been sent to The Stanislaus County Superior court and to Chicago Title Company's Atternys The plaintiff, Hershorin and Henry LLP, twice via mail.
Currently Hershorin and Henry LLP, Chicago Titles Arrornys are suing us for the $10,000 and $400 a day, when they have never served us and they are holding our Escrow funds for no reason. Leagly we filed in Small claims court, the case was heard and setteled over a year ago. Hershorin and Henry as well as Chicago Title are well aware it was setteled and holding our funds. They new this before they filed after being told so in the quashed case in Madera. To date we have never recieved a subpena on any case in Stanislaus County with Chicago Title or Hershorin and Henry LLP. We can not even talk to the attornys without them billing us. We are retired senior citizens and they harrasment needs to stop.
