Run - don't walk - away from doing business with this "backyard breeder". Don’t be a victim of this puppy farm breeder’s scam. Here is how it works:
Ms. Merle Tucker dba Castle Creek Cavaliers was glad to offer me a “Foster” arrangement which, after a couple of future litters, the AKC Cavalier King Charles Spaniel puppy would be “free”. The Agreement sounded very simple and straightforward. You pay a “security deposit” of $2200 cash and receive an AKC puppy to care for, love and train at home. In exchange, you make the puppy available to have two litters of AKC pups over the next 24-36 months which the breeder is entitled to keep all the puppies. After each successful litter, the breeder agrees to refund half the deposit and, following the second successful litter, the dog’s ownership – and AKC papers - would be transferred to you.
Ultimately, the breeder kept two healthy litters of pups ($15,000 value), abducted the dog ($2200 value), kept the second half of my refundable deposit ($1400), refused to respond to my repeated written requests for my valuable AKC puppy and the balance of my cash deposit to be returned. It also now has the dog which can have a third litter ($10,000) and could then sell the dog to another customer ($2,200).
Ms. Tucker - only when threatened in writing with legal action - verbally claimed (without any documentation or verifiable evidence whatsoever) I was not taking proper care of the dog because its ears were “dirty”, it’s nails need trimming and its coat was “matted”. IT WAS 13 WEEKS PREGNANT AND READY TO GIVE BIRTH. Should I have taken it to the groomer first? Absolute nonsense.
The most damning evidence against this breeder’s claims is that a few weeks before turning our pup over to Ms Tucker for the second litter, the dog underwent a comprehensive physical examination by a licensed Doctor of Veterinary Medicine at Surfside Animal Hospital who fully and completely documented the dog was, in fact, perfectly healthy and well cared for. The dog did have a minor ear infection which I was already working with the vet to treat. I have three other healthy and well cared for animals who regularly visit my veterinarian for routine examinations and occasional treatment.
I have personally LOST THOUSANDS OF DOLLARS through what I believe is an unethical breeder perpetrating a blatant consumer “Foster Family” scam. The heart of the scam is the Foster Family Agreement” which is intentionally written by the breeder to allow them to re-take possession of the dog for almost any unsupported claim. No evidence or documentation is necessary – she just keeps the dog, all the puppies and your deposit money too! The Foster Family Agreement - written by and for the sole benefit of an unscrupulous breeder - contains a laundry list of ridiculous care requirements, vague/non-existent standards, no notice of breach or right to cure provisions, and even a buried sentence with allows the breeder to SUE YOU FOR $25,000!
My advice, based upon my personal involvement of the interactions with this breeder over the past three years is simple. 1. Read ALL the customer reviews on social media including Yelp (especially those below labeled as "not currently recommended") as they are accurate customer reviews consistent with my experiences. 2. Do a Google search for "be aware castle creek cavaliers" for more consumer review sites and public court links. 3. DO NOT SIGN ON TO ANYTHING SIMILAR TO A “FOSTER FAMILY AGREEMENT” as they are filled with vague requirements, loopholes and caveats that the breeder can – and did – use to falsely justify walking away and taking everything. 4. According to the American Kennel Club, reputable breeders will always give you a FULL (not partial) MONEY BACK GUARANTEE IN WRITING if you ever want to return the puppy for any reason.
In retrospect, I wish I had done just thirty minutes of public domain research before choosing a breeder. It is important for anyone considering a breeder to remember that this profession (unlike a veterinarian) requires NO specialized education, NO trade school, No professional experience, NO college degrees, NO professional certification, NO state or federal licensing and NO on-site inspections. Any high-school drop-out can become a full-time dog breeder.
DON’T BE A VICTIM! It is my opinion, this breeder is knowingly and intentionally PERPETRATING A SCAM and CONSUMER FRAUD which needs to be publically exposed, investigated by all consumer regulatory agencies and ultimately shut down and put out of business permanently.
