I am filing this complaint against a car dealer with whom I completed a transaction via eBay, yet did not receive the car in the condition as advertised on their site. I believe this is an internal eBay issue, because the Seller (brauliocotero14) is going outside of their payment policy to collect money directly from the Buyers and they are allowing him to continue posting car sales on their site.

This is what happened: The Seller posted a "completely restored" 1968 Mustang for sale for $21,500. The ad described a beautiful car, what had been done to restore it, what items were brand new, beautiful pictures, and a video of the car being driven. I spoke with the Seller (or his representative, Eddie) directly on two occasions and he assured me there was nothing wrong with the vehicle, it was beautiful as described, ran perfectly, road ready.

When I purchased the car via "Buy It Now", the seller sent me an email asking that I call his number and he provided me wiring instructions. (I get mixed messages from eBay because they told me they do not send an invoice for cars, only the deposit, and yet the Sellers are not allowed to conduct any transaction outside of eBay (which he did).

The business name is AJ Auto Sales, Inc. Yet I've not been able to find a location for them online. I did not pay via an eBay invoice. I wired the money to the Seller and asked for the car to be shipped to me. When I received the car it was not operable or in the condition as declared by the Seller; a rat had eaten huge holes in the interior, the clutch and steering did not work well enough to safely drive, and after driving it 3 miles I barely made it home.

Then the oil drained out in my driveway due to a rear seal leak. The battery died the next day and upon removal, the entire engine compartment hidden underneath was completely rusted out leaving a 12" hole, where the battery literally could have fallen out of the car. All this within 2 days of receiving the car and without a professional mechanic to determine what else may be wrong with it.

Then I received an email from eBay stating the Seller opened a case for Non-Payment. I emailed the seller asking him to close the case because the car was paid. After I discovered that the car was no where near the condition the Seller promised, I called eBay to complain and was informed that it was my burden because I didn't inspect the car personally or hire someone to do it for me as I live 750 miles from the dealer.

So I needed to contact the Seller to try to work out a resolution. I sent the Seller two emails, one with my complaint, asking for $4,000 repair reimbursements to bring the car up to his description, and one to again ask that he cancel the Non-Payment case. The Seller did not respond to me. Rather, what he does is open Non-Payment cases and let them expire within eBay's timeframe to respond, so the Ebay "system" thinks the car is unpaid, and then he appeals to the Seller Feedback dept. to have negative feedback removed because the transaction wasn't completed.

I have since discovered that eBay Sellers can pay EBay to remove negative feedback. This is my major complaint with eBay and the reason I'm reporting him to you as a fraudulent Seller. The Dealer has worked their system so that Buyers he cheats cannot leave negative feedback warning other potential buyers of his scam.

Unfortunately eBay's Buyer Protection does not cover mechanical discrepancies with used cars and I didn't have the car inspected so I have no claim. Bottom line, my complaint is that a Seller/Dealer is advertising cars as completely restored, potentially lying to people and deceiving them with old pictures and video as he did me, and providing defective vehicles, leaving them with no recourse with eBay to even provide negative feedback which is intended to warn future buyers.

His feedback is 100% and I cannot be the only person who's been scammed by this man. I paid $21,500 + shipping for a car that I have to have towed for repairs, while the Seller/Dealer continues to run advertisements just like mine for restored cars on eBay.

The eBay Security Team say they are investigating this Seller, but have not indicated I will be involved going forward. Since he can pay to have negative feedback removed, I doubt he will incur any sanctions from eBay. BUYER BEWARE, DO NOT BUY A CAR FROM THIS MAN OR HIS REPRESENTATIVES AT AJ AUTO SALES, INC.
