My company Quantum Process, LLC is a process serving company who contracts to individuals to serve legal process. Since July of 2016, I have contracted to Blake Wallace 1656 Calvary Dr., SW Bogue Chitto, MS 39629 to serve process in Lincoln County, MS. It is my understanding that Mr. Wallace also owns and operates Blake Wallace Comfort Zone, Inc which is an air conditioning contracting service (not related to this dispute). Mr. Wallace started out serving process in a timely manner. However, as time went on he was not returning calls, emails or responding via text regarding services we had sent to him. In particular, there were four services starting in January 2017 up through March 2017 that were behind on status updates and not being attempted. Multiple calls, emails and texts were sent to Mr. Wallace. Mr. Wallace stated he had been working out of town on a new job and has not been able to "serve papers as often.
My companies reputation was damaged by Mr. Wallaces lack of concern, lack of communication and his job performance was extremely poor. When confronted about his job performance he stated that he was going to "discard them (meaning the service papers) and any information I have for them (see attached text). Therefore, he took payment but refused to provide a proof of service or nonservice and any information he may have discovered. I advised him to send a refund check or my checks back in which he replied that he would destroy two of the four checks sent to him. My issue is that he had time sensitive court papers that needed to be attempted and he is wilfully witholding information that he was paid for. Furthermore, the time lost in the three months that he had these papers cannot be recovered and due to his performance my reputation with my clients in these matters has been damaged.
Lastly, when I asked Mr. Wallace again to return the checks or affidavit's of nonservice or service for his attempts, etc he responded, "Look, d**k! I'm not hard to get along with but I don't appreciate you saying I said something that I clearly didn't. As you will see in the picture that i'm sendin you,I clearly stated that I was going to destroy the papers, checks and the information I had gathered to be able to properly serve the individuals. If you want to be technical, I should have cashed 2 of the checks after i had printed them out using my ink, paper And printer. I had also made 2 attempts on each already and was on the verge of serving them when you messaged being an a** hole. I have done expressed that I was having trouble accessing my email and serving them due to working long hours out of town on a new job. So excuse me for not wasting anymore of my time, money or effort to get you a check back when I can simply destroy it with the other paperwork. It is no reason for you to contact me again.
