San Francisco District Attorney Chesa Boudin announced Thursday the lodging of 18 felony charges against a Southern California lawyer who allegedly threatened Bay Area small businesses with lawsuits under the Americans With Disabilities Act.
Kousha Berokim of the law firm Berokim & Duel in Beverly Hills allegedly told the business owners that he represented a blind client and would sue the businesses for website accessibility violations if they did not pay him, prosecutors said.
Berokim's statements were false, according to the District Attorney's Office, because he had no actual intent to sue and in fact did not sue the businesses who refused to pay him.
Kousha Berokim, State Bar #242763. A lawyer who publicly admitted to taking client money from his client trust account and spending it to pay for his personal expenses. Berokim was suspended from the practice of law for thirty days by the California State Bar for this offense and is serving two years suspension. The order took effect January 7, 2015.
Berokim is a defendant being sued by Dell Canon Investments LLC. Los Angeles Superior Court case number BC572344. The complaint for damages alleges:

2. Fraud and Deceit
3. Constructive Fraud
4. Breach of Fiduciary Duty
5. Conversion
6. Breach of Contract
Berokim served as counsel for Dell Canon Investments, LLC. Plaintiffs allege that Berokim would not provide records for his legal expenses and was not being forthright when an accounting was demanded.
When Berokim produced an accounting for $138,600.00 in legal fees it lacked clarity. Plaintiff's allege that $339,000 was also missing and unaccounted for in his handling of Dell Canon finances. Plaintiff alleges that other Dell Canon monies were either negligently or intentionally misappropriated from Dell Canon to Berokim.
