I am a tenant in good standing, my rent has never been paid late and I am paid through this month of November, I never had a single complaint made against me, nor have I ever broken even one clause in my lease agreement. I recently received a letter by a law firm named Ostrowitz & Ostrowitz claiming to represent BCB bank which notified me of my eviction date. I cannot afford to give an attorney $5,000 to represent me. I have been hospitalized for one week in critical condition and am still gravely ill. I was NOT served through the court process nor was my residence ever posted. Although the attorneys claim my residence was posted I went to the local court house and the sheriffs department which handles evictions had no paperwork naming me in anything. I wish to express to the attorneys involved and UPPER MANAGEMENT AT BCB BANK that there are legal statues within the Anti-Eviction Act of New Jersey that hold the bank and their attorneys legally responsible even if they trample over me and evict me. No one would even know that this day and age a legal upstanding tenant could be steam rolled by a bank and their attorneys, if it wasn't for this very website. I am open to arbitration and this very site provides such arbitration. To the executives of BCB bank, I implore you to implement over sight of your attorneys actions.
BCB Bank attorneys Rita Mungioli and Ostrowitz and Ostrowitz ordered a fraudulent and illegal appraisal to claim there was no equity in my home in order to circumvent the laws that protect home owners rights. I have sent my appraisal to attorneys Rita Mungioli as well as Ostrowitz and Ostrowitz proving the extreme difference of approx. $150,000+ between their doctored appraisal and my legal transparent one. Their appraisal states my home is a one story dwelling with approx. 2,000 sq ft. seven rooms and 1.5 bath. My home is approx. 5,000 sq ft. 7.5 bathrooms and a 2 1/2 story dwelling with 18 rooms.
In addition I have sent Rita Mungioli as well as Ostrowitz and Ostrowitz proof that BCB bank has stolen from my BCB bank account with interest, penalties and trebel damages included totaling hundreds of thousands of dollars.
If it wasn't for Rip off Report and the First Amendment I would have no voice since BCB bank can spend untold sums illegally foreclosing on innocent unknown homeowners, short BCB costumer's accounts thousands of dollars and illegally threaten and coerce bonafide paying tendants with the threat of unlawful eviction by completely ignoring the New Jersey Anti Eviction Act.
BCB Bank illegally sold my loan to 110 Skyline LLC with a fictitious fabricated loan statement that when 110 Skyline LLC actually looked into the loan further discovered major discrepancies and as a result sued me for millions of dollars only because BCB Bank was selling loans to 110 Skyline LLC that were doctored to look much more appealing to 110 Skyline LLC. Unfortunately I have to spend a lot of monies now in the hope that I can bring this criminal enterprise (BCB Bank) to light so hundreds of other innocent victims can be made fiscally whole again.
I have sent numerous documents, faxes, and E-Mails to the attorneys, Ostrowitz & Ostrowitz. I have recieved no response back from either BCB Bank or their attorneys Ostrowitz & Ostrowitz nor their Head Council Attorney, Rita Mungioli whom is also fully aware of the theft of monies in the amount of $52,728.85 from my account. With back interest, pentalies, as well as punitive damages, the amount far exceeds the initial theft of $52,728.85.
BCB Bank is "stone walling" me through their compromised attorneys (Rita Mungioli and Ostrowitz & Ostrowitz). The Office of Attorney Ethics of Supreme Court of New Jersey states that attorneys whom do not uphold the law are subject to discipline ranging from admonition to disbarment.
Attorney Rita Mungioli, whom works for BCB Bank intentionally ordered an exterior appraisal of my home from the street, which listed my home as two bedrooms and one bath, when in fact it is a 4 bedroom 8 bath home with approximately 5,000 square feet. Rita Mungioli purposely used a bank appraiser to make the home appear to be worth far less so they could forclose on the home and in return, capitalize on the tremendous equity.
Rita Mungioli signed off on paperwork stating she is subject to prosecution if anything she stated or attested to was false. She clearly broke many banking laws and should be disciplined and/or disbared for her fraudulent actions. BCB Bank should also be fined and forced to pay punitive damages.
What was the name of the appraisal company? I'm having the same problem. They foreclosed on me in November 2018. Noe coming after me for a deficiency judgement. I'm counter suing BCB for consumer fraud
