Texas attorney Cagney McCormick knew attorney Philip Galyen, Bailey Galyen , Bedford, Texas had employed an attorney who destroyed records and altered other records to hide fraudulent conduct. Philip Galyen was repeatedly requested to forfeit the client file to the client, but refused to do so. Cagney McCormick was notified through certified mail to provide the original client file. Cagney McCormick, knew fraud was perpetrated. Specifically, Cagney McCormick was aware that Houston attorney Thomas Fredrick Jones aka Fred Jones had fraudulently filed papers with the federal court. An expert said the attorney had comitted fraud. Indeed, in my opinion such conduct is fraudulent.”
Philip Galyen was aware of a pending federal investigation, but did nothing to secure the file as he was required to. This allowed Thomas Fredrick Jones to alter records and destroy other records in the file. Cagney McCormick was complicit with this conduct where he adamently refused to do provide the client with the original file to be used in court against Bailey & Galyen. The law obligates the attorney to turn over the original file - see TX Rule 1.15(d), states in part, “Upon termination of representation, a lawyer shall take steps to the extent reasonably practicable to protect a client's interests.. surrendering papers and property to which the client…”
In sum, Cagney McCormick to abide by the oath to be an officer of the court and to ferret out fraud even when Bailey & Galyen makes allegations it fights corporate fraud. Attorney Cagney McCormick appears to not have any ethics or values and would rather cover up fraud than expose it by providing the original file.
