On December 31 2015 I went to Auto Nation Toyota located at 9101 Research Drive Irvine, CA 92618 to purchase a used 2012 Toyota Prius automobile for about $16,125.00. Before purchasing the car I wanted to findout if I would get favorable financing terms since I have impeccable credit. The Salesman Shawyon Movahed and his Manager Jamal Zadran that they would only conduct a soft credit inquiry before letting me know what terms they could offer. I made sure to ask them more than twice if they were sure that was the case on the soft enquiry they both replied yes. I was told Shawyon Movahed and his Manager Jamal Zadran to fill out a finance application to get an idea of the rates they could offer me and the terms. They then provided me with a quotation that was highly unusual with the rate at 7.98 % since my fico score is over 650. After reviewing the quotation I felt I could get a better deal at another Toyota dealership. I then asked the Salesman Shawyon Movahed and his Manager Jamal Zadran for my finance application since they had no need for the information they then stated that they couldn’t due to the Patriot Act. I then asked them if they had proof or documentation verifying this they said they didn’t I then asked them if I brought them a copy of the Patriot Act that they would be able to show me this they said absolutely. I then went home and went on my computer signed on to my credit monitoring service only to find out that there was 3 total hard credit inquiries one my Trans Union credit report and 1 hard hit for Equifax credit report and of course one on my Experian report all by AutoNation done on the same day 12/31/15 at the same time. I then called on the telephone the Salesman Shawyon Movahed and couldn’t reach him so I called the Sales Manager Jamal Zadran and told him about what had happened relative to my credit reports; His response was that it was incorrect and if there was a problem they would try to fix it. I explained to Sales Manager Jamal Zadran that he blatantly lied to me in my face about the hard credit inquiry, and that this is totally outrageous that this could take place. I then asked the Sales Manager Jamal Zadran why they ran a hard credit inquiry on my report knowing that he told me something completely different. He couldn’t give me an explanation at all as to the reasoning behind this.
On 1/1/16 I then drove over to the dealership I then verified with Finance Manager Jamal Zadran and meet his boss Donny Ahmadpour who was representing himself as part of the finance team I asked for his business card he wouldn’t provide it. I then asked him why from a finance department point of view they ran a hard inquiry on all three credit bureaus when they told me multiple times that they wouldn’t His explanation was that it was a mistake and that the Sales Manager Jamal Zadran would have letters sent to the three credit bureaus verifying the mistake and to remove the inquiries by Friday 1/8/16 DID I EVER GET THE LETTER???? NO!!! I then asked based on the experience that I have had with your automobile dealership why couldn’t I get my personal information that could be used to create a new identity or maybe even worse back since I have had such a bad experience with your automobile dealership Donny said that he couldn’t due to the Patriot Act. I said fair enough I asked if he had documentation he could show me he said he didn’t. I then asked Donny that if I brought over a copy of the Patriot Act for automobile purchases that he would show me where it would state that they could not give me back the Automobile Finance Application that I filled out his response was yes.
On 1/1/16 I went home after visiting the dealership and downloaded a copy of the Patriot Act for Automobile Purchases and read through the entire document to find the clause that stated that they could not give me back my Automobile Finance Application I could find nothing.
I then went back to the dealership on 1/2/16 and had in hand a copy of the Patriot Act for Automobile Purchases and a copy of my credit history showing the 3 hard inquiries for Trans Union and for Equifax as well as Experian the so called Finance Manager Donny Ahmadpour I then asked Donnie to show me on Patriot Act for automobile purchases to show me where it would clearly state that they could not give me back the Automobile Finance Application that I filled out he said that he couldn’t and to call the California Department of Motor Vehicles and they would be able to provide me with an answer. I then asked for his card to which he stated he couldn’t. I then asked him for any employees card in the finance department he said he couldn’t provide anyones business card in the finance department. To this day they never removed the hard credit inquiries on any of my credit reports.
