On November 19, 2016, I purchased a 2013 Nissan Pathfinder color gray from APS Auto Sales and Leasing located at 3747 E Speedway Blvd. Tucson, AZ. 85716. I had purchased the vehicle at 4:00 p.m. and at approximately 6:00 p.m., I called the APS Auto Sales to inform them that the transmission had failed. A APS Auto Sales representative advised me to bring in the vehicle on Monday morning. The 2013 Nissan Pathfinder was dropped off at 4:30 a.m. on Monday, November 21, 2016.

I called APS Auto Sales at 8:00 a.m. to inform that the key was left on top of the driver’s side front tire. The APS Auto Sales representative advised me thanks and he further assured me that the 2013 Nissan Pathfinder would be towed to the Nissan Tucson Dealership for recall.

I called APS Auto Sales at noon that same day for a status on the 2013 Nissan Pathfinder. The APS Auto Sales representative advised me that the vehicle was currently at the Nissan Tucson Dealership.

I called APS Auto Sales at 3:30 p.m that same day for a status on the 2013 Nissan Pathfinder. The APS Auto Sales representative advised me that the vehicle had been repaired and ready for pickup at APS Auto Sales.

When I arrived at APS Auto Sales at 4:00 p.m., the APS Auto Sales representative advised me that the contract had changed, not to worry; everything stayed the same except the loaning agency. When I read the contract, the total price had changed. The original price for the 2013 Nissan Pathfinder was $19, 740, 00. The new contract price was listed at $21, 490.00. The APS Auto Sales representative stated that the reason for the price increase was due to loss of profits. I refused the contract. The APS Auto Sales representative then gave me the keys to my original 2014 Nissan Sentra.

On the same day, I then called my Loaning Agency (Advantage West) to notify them to cancel the loan for the 2013 Nissan Pathfinder. The Advantage West representative advised me to request a voided contract with APS Auto Sales.

On Tuesday, November 22, 2016, I called APS Auto Sales and the representative advised me to come down and that he would provide me with a voided contract. When I arrived at, the APS Auto Sales representative refused to provide me with the voided contract and that he would be reported to the local authorities due to the fact he had stolen the 2014 Nissan Sentra and that the vehicle would be removed from his possession. Furthermore, the APS Auto Sales representative advised me that he had already used the loan to payoff lender Morgan Chase.

On Saturday, November 26, 2016, I called up Morgan Chase and the representative advised me that they had no knowledge of the payoff.
