My husband bought a property from Andrius Vilcinskas (dba Power Savers, LLC) in March 2014 from Ebay for us to renovate in Granite City, IL. Vilcinskas gave us a quit claim deed which he had agreed to register with the court recorder (my husband paid extra for that). However, Vilcinskas never had the quit claim deed recorded. The wording of the listing for the property on the county recorder website was odd, saying "Quit Claim deed" from about the time we bought the property and I thought perhaps the county office might be behind in updating the county website (which, in truth, takes a long time to be updated).

We went ahead with our plans to renovate the building, even getting a zone variance from Granite City for the property. After several months, when the county website did not change, I contacted the county recorder to make certain our quit claim deed was properly recorded. Andrius Vilcinskas had just sold our property to a second individual even though Vilcinskas no longer owned the property! He sold the property for a tenth of the price we paid and the buyer had his quit claim deed recorded promptly by the county.

Fortunately, we had a notarized quit claim deed from Vilcinskas and eventually the county recorder got us listed as the owner and the second buyer was removed from the deed. However, this process caused us a lot of time and grief and we lost money over the deal, not to mention that the second buyer was completely out of the money he spent. There was a second property of little value in Detroit which we bought at the same time from Vilcinskas. We received the quit claim deed about the same time as the one in Granite City, but again, Vilcinskas never had the quit claim deed recorded as he agreed in the sales agreement. I am very concerned about Andrius Vilcinskas selling properties to more than one buyer by promising to record quit claim deeds and then not doing it. This seems to be one of his major ploys in defrauding people, and I would like to participate in any legal action against him.

In my opinion there are several aspects to the ongoing widespread property fraud in the USA, of which Vincinskas is just one part. The sales venues, such as Ebay and other auction sites, should not be able to skate by without consequence on this matter. Every property we purchased through Ebay was on the demolition list, including the ones sold to us by Vilcinskas. The various counties in several states are not flagging properties on the demolition lists or changing their appraised value based on the lists, even when they are notified by a city that a certain property is scheduled for demolition. One property we bought was demolished within a month of our purchase before we even got there to see it. The house had been on the demolition list for over 2 years and the former owners were notified. We now owe taxes for a house that no longer exists.

Yes, some people will say that we were foolish to buy property on Ebay (I agree) and so we are responsbile for our own losses. But "caveat emptor" (buyer beware) cannot condone ongoing property fraud. In my opinion, nothing but a class action suit (or a couple of class action suits) will address this ongoing widespread property fraud at so many levels that affects so many people. I would love to join forces with anyone else who is interested in such a class action suit.
