These people seem to think that they have a right to bully and manipulate tenants in order to obtain the maximum advantage for the owners. Emma withheld our bond at the end of a tenancy because items were left on public property for council pickup. This is despite the fact that a council pickup was booked. Further, Emma conveniently ignored the fact that the owner's left a very heavy railing in the same spot for us to dispose of at the start of the lease without so much as arranging the pickup. This cost us $530 to dispose of along with a huge amount of green waste from the overgrown gardens. Emma's justification for withholding the bond was that he nature strip in front of the house was actually part of the property because we usually mowed it. I would suggest that anyone working in this industry should better acquaint themselves with the relevant laws, but I know that ignorance is not the issue. Emma has probably been getting away with bullying tenants for a long time and has no doubt done so successfully and without repercussions. There is a huge power imbalance between agent and tenant and Emma seems only too happy to abuse that power to gain advantage. People like Emma should be banned from working in this industry. I am taking this matter up with Fair Trading and NCAT, but really such measures should not be necessary. If you are a property owner looking for an agent, then I suggest you look for a more honest agency to represent you. It is not in your interests to engage an agent that will result in a pugilistic relationship with the people living on your property. It is simply unnecessary.
