We have fallen a victim to an unscrupulous and predatory broker who has targeted us along with many others who have become victims to his deceit and predatory lending practices, which are tantamount to extortion. Dmitrii Gordon of Amerimax Capital, LLC should be investigated and appropriate action should be taken to prevent his disgraceful and damaging business practices, which border on criminal violations.
When initially approached Mr. Gordon, promises a 30 day closing and rates inline with the lowest market rate. He then requests documents, 2-3 days after the documents are provided, he calls and states that he spoke with the lender and everything is arranged, he just needs a retainer agreement and security deposit, of only $500.
What is even more astonishing is that according to nmlsconsumeraccess.org, neither Mr. Gordon nor his company Amerimax Capital, LLC are licensed to sell financial products or broker loans. Subsequently, Mr. Gordon violated NYS Banking Law § 590[2][b] prohibiting, inter alia, the solicitation or negotiation of a residential mortgage loan absent license as a mortgage broker. He, therefore, should be sanctioned for unlicensed business practices.
However, after providing him with a $500 retainer and executing the agreement, which he rushes to execution saying that a binding letter of intent is coming in a few hours, and he needs the agreement to ensure that everything is proper, everything starts to shift in a different direction.
Almost immediately after execution of the agreement, Mr. Gordon calls and states that he spoke with the lender and the committee came back with some good and bad news. The good news is that the loan is still good and that closing can take place very quickly but the bad is that in order for you to get low interest rates, you need to buy additional points which value in tens of thousands dollars.
Upon confronting Dmitrii Gordon and notifying him that this was not what was agreed upon and promised, we have notified him we will entertain additional quotes from different brokers.
When we found a suitable broker who actually delivered his promises three months later Dmitrii Grodon on behalf of Amerimax Capital LLC and his attorney Yosef Weintraub, Weintraub LLC filed suit for breach of contract, and we have received a complaint from the Supreme Court of the State Of New York. The amount in the complaint is rather small and his hope is that since the legal fees to defend the action will cost more than the demand, we would settle and give him something.
His actions could be described as nothing less but extortion, and represent a pattern since upon the most basic due diligence we identified several other people who suffered the same extortion scheme. Whereby, he deliberately provides loan terms knowing that the borrower will not close, and then when fired or not used as a broker, he sues for his points saying that he performed and it was a choice of the borrower not to use him.
How dare he extort money from the working people during such a crisis and pandemic that’s happening? Have we not suffered enough? Does he have any dignity? Is he not human?
Further, on our own mistake, by trusting him and his deceitful smile, we apparently have joined an agreement with him which we could not escape for 5 years.
He apparently has locked us into an exclusive agreement where we can work only with him for a period of 60 months.
We urge everyone who deals and works with Dmitrii Gordon not to be taken advantage of as we have been.
