My husband and I purchased a water softener and filtration system from the American Water Company on 3-21-17. Our salesman Barry Brockman assured us the financing loan for the products through ISPC was an unsecured installment loan, and that our installation cost would be free. We also were told there would be 6 month deferred payments, without interest. They installed the products before the finance papers were ever signed or approved. Our salesperson, Barry, dated back the date of installation (3-23-17) to the date of purchase (3-21-17), which gave us no time to even read our new contract with ISPC whom it was financed through. We did not realize this until later. We have come to realize that none of the promises were true. Barry, our salesman, came back the day after installation when my husband wasn’t home, and told me he had more papers for me to sign. It was raining and he said they were just 'dotting i’s and crossing t’s’. I asked if I was allowed to sign them since my husband was the one who was approved for the purchase. He said yes, so I signed them. I saw the date at the bottom of the papers I signed was 3-21-17, the date of purchase, and when I attempted to correct it he stopped me and told me to leave it there. He was a very nice guy, so I didn’t think anything of it. Come to find out, the papers I signed in place of my husband were replacing our original contract and agreement with the American Water Company entirely. The papers I signed agreed to pay $500 installation costs (please keep in mind, they’d already installed it at that point). My husband read the papers when he got home and called Barry to ask him why we were expected to pay installation costs now when that wasn’t part of the agreement my husband signed. Barry stated that was just part of the copy, and we weren’t being charged for the installation, explaining it away in big and confusing ways. We trusted him. Months later, we noticed charges for $10/month being withdrawn from our checking account under the name 'Covenant Capital Logistics’. We researched the name and found that this is a finance company owned by Jared Williams, the owner of American Water Company. We called and asked for them to explain the charges, and they stated that the charges were for the installation fees, and that they had been financed separately with Covenant Capital Logistics. We advised them we did not agree to that, and that we had never even heard of, or were told about them as a company by our salesman or the water company. I spoke with Paul Fines today (11-13-2018) and he let me know that Covenant Capital Logistics is indeed a completely separate company from American Water Company (although a simple google search will reveal they are both owned by Jared Williams). Also, this was NOT an installment loan. This line of credit is being reported to the credit bureaus under my husbands name as a 'credit card’- that’s right, we are now the proud owners of an almost maxed out $9,500 CREDIT CARD that we will never pay off because only 1/4 of our monthly payment of $120 goes toward the actual amount owed, most of it goes toward the interest rate. The 6 month deferred payments interest free were not true either; we had no payments for 6 months, were charged $63 per month for interest alone (which is calculated in some obscure way by ISPC), and is certainly not the 7.9% we agreed to. When Paul called us today (11-13-2018) he stated that they are still seeking payment for the remaining $402 for the installation costs. I explained to him that was not what we agreed to. I also would like for CCL to mail copies of any paperwork I signed on their companies letterhead. I have no paperwork for them; ALL OF IT is clearly printed on the American Water Companies letterhead. I’m also confused as to how they got ahold of my banking information in the first place. I would certainly have told my husband if I’d given our account information to them, and vis versa. He stated he wants the issue to be resolved (I quote) 'before it gets ugly’. To me, that was intimidating and threatening, and he said it twice. I made a point to be polite to him on the phone because this is not directly his fault, but I do believe that they should be held responsible. Paul also stated that he was newer to CCL, and that the bookkeeping in the past was not up to par (in my own words), and that he’s been trying to fix things around there as the company is realizing things they were doing wrong. He stated that 'everyone is human and makes mistakes’, as if I should just give the company a free pass and pay the $402. I politely hung up and explained I’d get back to him soon, which I plan to uphold. I have been in contact with two other consumers who have fallen prey to their schemes. I believe there are more people out there who have been duped by these companies, and invite them to speak up as we are seeking legal help as a whole.
