Allmand Boats FRAUD!! FRAUD!! FRAUD!!

FRAUD!! FRAUD!! FRAUD!! DO NOT DO BUSINESS WITH THIS COMPANY. MY WIFE LOST $180,000 DUE TO A SCHEME TO FRAUD RUN BY TODD ALLMAND (TODD CALDWELL) AND HIS COMPANY. THERE ARE (3) OTHER CUSTOMERS THAT HAVE ALSO BEEN DUPED BY THIS COMPANY WHICH YOU CAN READ ABOUT ON "THE HULL TRUTH" BOATING FORUM, AND THE BETTER BUSINESS BUREAU OF CINCINNATI, OH. HE TAKES YOUR DEPOSIT MONEY, PROVIDES A CONTRACT AND A 90 DAY DELIVERANCE, BUT THEN HE CHANGES THE CONTRACT AND ADDS TO THE PRICE DURING THE CONSTRUCTION OF THE BOAT. OUR BOAT TOOK 1 1/2 YEARS TO COMPLETE. WE PAID FOR A BRAND NEW 33' WATER TAXI AND WHEN IT ARRIVED IN FT. LAUDERDALE, FL IT WAS OLD, BROKEN, DAMAGED CRACKED AND UNASSEMBLED. THE BOAT DOES NOT HAVE A HULL ID # ON THE BOAT, BUT HE CERTIFIES ON THE FEDERAL COAST GUARD CJ-1261 BUILDERS CERTIFICATE AND FIRST TRANSFER OF TITLE THAT THERE IS A HULL ID. WE CANT SELL THE BOAT NOW WITHOUT A HULL ID. WE ARE IN A LAWSUIT WITH THIS COMPANY TO RECOVER OUR MONEY AND RETURN OF THE BOAT DUE TO HIS SCHEME TO FRAUD. WE HAVE ALSO FILED FELONY CRIMINAL CHARGES WITH THE FBI AND THE COAST GUARD FOR FALSIFYING FEDERAL DOCUMENTS.

BALONEY CLAIM Counter suit for non payment, defamations suit in process

Counter suit for non payment, defamations suit in process Stay posted to see the results of this baloney claim. The points will be proven false below using evidence and their own words that will come out in a defamation suit and the counter suit.

Many things about this claim are fishy.

1. First they said they were going to give the boat to a third party Bahamian to operate a tour service. However they could not produce a captain's license from him so they could not get insurance. It was not until a highly respected marine engineer who was paid to put the engines on the boat provided his captain's license that the marina allowed the boat to be off loaded from the truck. Then as soon as it was unloaded they fired the engineer on for baloney reasons.

2. They have all the docs they need to prove ownership. Hull ID is a vinyl sticker that anyone can get at a print shop for $5.00, if they did not want to pay $5 why not ask for one; it would have been mailed to them at a cost of $5.42. Fact is they have the documentation with the hull # ANYONE WITH HALF A BRAIN CAN PUT ON THE HULL # STICKER AND SELL THE HULL, THAT IS ALL THAT IS NEEDED TO STICK ON A STUPID CHEAP STICKER

3. The BBB is just like this forum anyone can say what they want. I can file a complaint that eating at Mc Donalds made me fat and they need to make me skinny again.

4. They made it impossible to finish by changing the design of the boat then not paying for work done (will present evidence at trail, this is their own words) Shortly after starting the work they instructed

"Can you cut our part of the deck and lower the head into the hull like in this picture."

We followed their direction and changing the structure of the hull added a great deal of work and time.

5. Here is another example why the boat took so long, most of the time sitting in storage for non payment for work done, when they got the bill for the extra work they asked for

"Thank for going to the trouble but this is not what I wanted and please don't charge me for it. "

then they say

"We should probably talk on the phone before you go to any more work on the boat. "

After that the work stopped and the boat sat in storage for months until they then said

"I am getting in touch with transportation companies to come and get my boat. I know I asked for a change in the bathroom and that involved some unforeseen expenses and extra time...it will be around $50,000 over budget if you keep working on it. "

REFERRING TO THE EXTRA WORK AND CHANGES THEY ASKED FOR BUT DID NOT PAY FOR.

We ordered a parasailing boat from Allmand boat in August, 2015. We were promised delivery in two months. However, it was not delivered until January, 2016, double of the promised time.

The boat hull was made in Qingdao, China and was labeled Allmand boat. The boat engines and necessary accessaries were shipped separately by Allmand boat, which arrived Saipan months before. However, we found that the engines shipped through Allmand boat missing necessary accessaries and propellers for the engines were wrong, too.

We struggled, with the help of local Evinrude outboard engine dealer to find necessary parts to installed engines to the hull shipped from China. We thought we finally could use the the boat. But to our surprise, the boat hull was missing the required HIN number, which was supposed to be provided by the boat builder or boat importer, in this case, Allmand boat.

When we requested this vital information, Mr. Allmand demanded an invoice from an Evinrude dealer for installing the engines before he would gave us the HIN number, claiming "it is the LAW". We searched everywhere for the law Mr. Allmand claimed to exist but failed to find any. In fact, among the people in boating communities we consulted, nobody had ever heard of this LAW.We requested Mr. Allmand to provide the law he claimed the he was complying, he refused, insisting that we, the consumer had to prove that the law did not exist.

Finally, Mr. Allmand expressed concern that we would not operate the boat safely. It was a complete surprise to us. He never expressed his concern before but very eager to import the boat for us. Now we had the boat, but could not use it.

To address his concern we offered to give him the boat back for refund or give us the require HIN. We even provided the invoice from Evinrude dealer he requested although we did not think he had the right to ask for the information. However, instead of giving us a HIN number, he claimed that we Dr.ed invoice and requested confidential dealer number! We feel that it's unethical and even illegal to sell a boat with no HIN number.

HIN is assigned by the person who becomes the manufacturer when they assemble the "Boat Kit"

The person imported the hull they refer to then put on their own engines and fuel systems

1. a blank hull needing engine and systems installed is called a Kit Boat

The person who mae this comment purchased a boat kit without engine or systems installed

Kit boats are a backyard built boats, but kit boat manufacturers are still subject to the regulations. The law says a "recreational vessel manufacturer" is "a person engaged in the manufacturing construction, assembly or importation of recreational vessels, components, or associated equipment." This means that a kit boat manufacturer is subject to the same rules as any boat manufacturer and must obtain a MIC from the U.S. Coast Guard. They must assign Hull Identification Numbers and supply any required labels. Also they must supply instructions to the builder so that the boat is built in compliance with the regulations.

3. The person who made this review purchased a Boat Kit not a functional boat. Read what they say and see they purchased a kit then expected to assemble the Boat Kit then put the liability on someone else. If they put the Boat Kit together wrong and there was injury it is not the fault of the company that sold the Boat Kit it therefore the person who put the engines and fuel systems in is responsible and is the one who needs to as the USCG for a HIN becauese they made the Boat Kit into a Boat by putting on engines and fuel systems.

The person who made this review imported the the hull and put engines on it making it a boat.
