ADP continued to charge our account after we discontinued their services. Also, if anyone is considering using them for 401K services -- I wouldn't. They are very expensive and when we needed to downsize, they charged expensive fees for us to discontinue the program. I know some of the fees were warranted, but it was a very bad experience and then when they couldn't get the fes from our company, they stole it from the accocunt of one employee that was enrolled in the program.
Just wasn't a good experience all the way around. THey could have worked with us but refused to. We've been with Paychex this year and are much happier with their service. You have choices, so why risk it?
ADP is unprofessional, immoral, and liars. ADP messed up on my sister's w2 and was given the run around by both her employer (who blamed ADP) and ADP (who blamed the employer). My sister tried calling ADP to get further assistance in which they denied her because she was not their client. She notifed her employer to call them to get things straightened out so that she can file her taxes. The employer never called ADP.
After days going by, and no resolution, I decided to contact the corporate offices myself. I spoke with a gentleman by the name of Rick who identified himself as the Senior Executive of Client Services. I explained to Rick that I am a registered and certified tax professional through the State of New York department of tasxation and finance and that the w2 would flag an immediate audit for my client, who is also my sister. Rick reiterated that ADP can not help at this time but would be willing to reach out to their client to let them know of the discrepancy on the w2.
Rick also stated, contrary to what my sisters employer told her, that they use the numbers provided to them by their clients to create the final w2 form. About 5 minutes after I got off the phone with Rick, my sister called me hysterical and in a panic mode that she was being fired from her management position due to ADP calling the client and stating that I called on behalf of the company claiming to be their CPA. I immediately called Rick back and now he is claiming they never said that and if my sister got fired that it has nothing to do with ADP.
This resulted from ADP's behavior by lying to their client about what was said during the conversation. Rick stated to me that he did not tell the client that I said I was calling on behalf of the company, but then he also told me he didn't even speak with the client directly, he sent an email to member services and they called. So, if you were not the one to call and speak with the client, how can you assure they did not tell the client that I called on behalf of them and acted as their CPA???
I also notified Rick I never once said I was a CPA (as there are tests you have to go through in order to be a CPA that I have yet to take) and he said "naturally one would assume a tax professional is an accountant/CPA. Rick tried to tell me this was a minor difference. It most certainly is NOT a minor difference when you call your client and LIE to them stating that their CPA called in regards to the discrepancy on the w2. That made a HUGE difference and the SOLE factor in my sister being released from her duty as the office manager.
Now, on to the next issue. My sister received a text message from her employer hours later saying they looked into the problem to see what the discrepancy was. He told her ADP told him the reason her wages were different is because she went tax exempt for some period of time during her period there and that ADP has a signed form from her stating she is tax exempt. Here is the issue with that, my sdister has NEVER went tax exempt and NEVER signed anything stating she was tax-exempt. So, at this point I have to assume ADP or her employer are falsifying records to supplement the difference in wages on her w2.
Also, even IF my sister went tax-exempt, according to 26 CFR 31.6051-1 of the USC it states: (iii) In the case of statements furnished by the employer for whom services are performed, with respect to wages paid after December 31, 1955, “the total amount of wages as defined in section 3401(a)”, as used in section 6051(a)(3), shall include all payments made directly by such employer under a wage continuation plan which constitute wages in accordance with paragraph (b)(8)(ii)(a) of § 31.3401(a)-1, without regard to whether tax has been withheld on such amounts. Thius means that even if you go exempt from tax withholdings, the amounts reported in box 1 of the w2 will NOT be affected.
ADP is considered unprofessional for the way they handled the situation. They acted immorally by lying to their client which resulted in the decision to terminate my sister. This company has no idea what they're doing and have no meaning of the word ethical. Rick has lied to me twice now. Even after he was told of the situation, he said he would contact the client to let them know it was a misunderstanding on HIS part, which he never did. These people lie and do not have good business practices. They seem very shady and I would be very cautious if you use their services.
