I sent this alleged company a letter stating that they provide me validation of the alleged claim. As I understand it, under the Fair Debt Collection Practices Act, available @ https://www.ftc.gov/enforcement/rules/rulemaking-regulatory-reform-proceedings/fair-debt-collection-practices-act-text, they are required to provide me after I request, via writing,
Validation of debts
(a) Notice of debt; contents
Within five days after the initial communication with a consumer in connection with the collection of any debt, a debt collector shall, unless the following information is contained in the initial communication or the consumer has paid the debt, send the consumer a written notice containing --
(1) the amount of the debt;
(2) the name of the creditor to whom the debt is owed;
(3) a statement that unless the consumer, within thirty days after receipt of the notice, disputes the validity of the debt, or any portion thereof, the debt will be assumed to be valid by the debt collector;
(4) a statement that if the consumer notifies the debt collector in writing within the thirty-day period that the debt, or any portion thereof, is disputed, the debt collector will obtain verification of the debt or a copy of a judgment against the consumer and a copy of such verification or judgment will be mailed to the consumer by the debt collector; and
(5) a statement that, upon the consumer's written request within the thirty-day period, the debt collector will provide the consumer with the name and address of the original creditor, if different from the current creditor.
I maintain that they have not done so, and further, ignored the law in providing me the requested validation. I also requested that I not be contacted via phone, added my number to the do not call registry (https://www.donotcall.gov/), and still received 2 calls.
Is there anything I can do to compel CCSC to provide validation of this alleged claim? If I can prove that they are violating the law and harassing me, what kind of damages can I sue them for? Can I sue the original creditor for putting me in this situation fraudulently? How would I have to go about proving fraud?
I do not believe that I owe $76.63 to Farmers Insurance or to Credit collection services. When i call to inquire about why I am being asked to pay this money, no one at Farmers can explain why I owe this money or justify the payment. I do not know how Credit collection Services got my personal informaytion, but they will not listen to me when I tell them that I do not owe this money.
I was shopping online last year to find lower insurance premiums than the one I have with Geico Insurance Co. I found that after a few days I was getting emails from Esurance that I needed to verify information that I didn't think they needed to know about as I had not purchased a policy from them. Earlier this year I recieved a letter from Credit Collection Services telling me that I owed $203.90 to Esurance for non payment of a policy that I purchased. I called and spoked to someone and told them that I had never purchased a policy and that I was merely shopping for lower premiums. When I answered all the questions she asked of me, she asked me if I could send her a copy of my Geico policy to show there was no elapsed time while I was looking for lower premiums which I did. On April 5, 2017 I received another letter from them and I called them again. I was given their website to send them a copy of my policy that was never stopped and I can't find where I can communicate with them or send them an email.
CCS sent a letter from a creditor - Geico Indemnity Company - the only thing I know Geico is the insurance co with a lizard in the tv commercials. Never had that insurance. They give me a settlement opportunity. It all looks legitimate, only it isn't. I am almost done repairing my credit and suspect this is a scam that resulted from that process, like my name was sold or possibly hacked. They have 3 different addresses on the letter. 725 Canton Street, Norwood, MA 02062 on the top, and PO Box 55126 Boston MA 02205 on the bottom of the letter. And in the middle of the letter a different address - CCS PO Box 607 Norwood MA 02062
I got a call at the very beginning of the year claiming I owe and Im still not sure, either progressive or CCS 15K. Unheard of. They caim I was in an accident in Nov. 2016, which if that's the case why did it take so long to get a hold of me, and why didn't progressive themselves try to get a hold of me to settle claim. Instead I got a nasty call and threatening letters stateing "failure to respond to letter a law suit will be filed against you and/or license suspe sion(contingent upon applicable state law.)"
This company has been calling my husband and I for 3 years now, looking for a person with the same first and last name and same birth date as our son but a different SSI number and middle name! This person lives far away in another state and I have told them since it started they have the wrong person. Somehow this persons credit file information was mixed with one of the credit reporting bureau files of our son. I have gone around and around with them. They kept insisting our son was the person they were looking for. This other man's info started showing up with ours in online searches. We would no sooner get our sons credit report straightened out and then this company would put the erroneous information back on.
This other person was married and had a child at some point. We got child support subpoena's, investigator calls, etc. Our son has always been single, never married, always lived in our state, born and raised and attended school here, was in college and had his school loan was shut down as a result of this. They never stopped calling and in fact started calling my husband and my cell phones! They called at least twice this month - my husband's cell this time. I've told them every time they have the wrong person. Three years now. I have been filing complaints with our attorney's general office and the FTC. They won't stop.
